Wouldn't running Emulators be a HUGE problem for Nintendo?

Your hardware is yours to do with as you please. The problem occurs when you either resell hardware not in it's original spec or when you tell others how to 'hack' your box so you can 'use backups' or other frowned upon stuff.

Creating usability that could encourage growth of the console shouldn't be frowned upon. Running an emulator is perfectly legal. Where you got your ROMs may not be. It's great that Nintendo will have so many classic games available but what I wonder is where do they all get stored? There definitely exists the potential for more companies to release older titles just as music companies started jumping on the digital music bandwagon. Funny thing is I only purchase hard copies of my music. I would be happy to purchase an EEPROM of any old game I wanted if I could but I would like a way to back them up.

Here's another idea, have a USB key or SD card with an encrypted file system. Make it so you can back that device up but the backup has to be restored to a similar device. Allow you to tag along your classics to a friend's house and play them in other locations. Also, make that device compatible between your Wii and a portable like the DS. So many possibilities.

Consider the size of most of the older games. Many of them won't exceed a couple megabytes so you could literally have hundreds of classics on a 512MB card.

But again, we should be able to avoid this fairly easily; just don't market this as an emulation tool. If we do what we can to be seen to be playing fair, that whatever Nintendo can or can't do, legally or techincally, and whether they will or won't do it... that all becomes academic. Let's not give them a reason to even consider it.

I agree with this portion. While I hope there are people willing to port emulators, it should never be outright discussed on these forums. However, there's been another idea of trying to get Nintendo involved in this project. I also think this is a massive mistake, as Nintendo is very protective.

It would definately be best just to keep this project as low key as possible and to not discuss the shadier programs on these forums (as they are the official ones). After it is up and running, then perhaps a bit of publicity wouldn't hurt but Tuxido ought to ensure that only complimentary things (as in things that don't conflict with Nintendo's interests) are officially discussed.
